Terms of Service

1. Acceptance of these Terms
These Terms of Service (the “Terms”) govern your access to and use of the Eat On Chain website, mobile interfaces, and related services (collectively, the “Service”). By connecting a wallet, placing an order, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. What the Service is
Eat On Chain operates a non-custodial ordering interface that accepts payment in USDC on the Solana blockchain in exchange for the placement of food-delivery orders with third-party merchants and couriers (including, without limitation, DoorDash, UberEats, Grubhub, and direct-to-restaurant channels). Eat On Chain is not affiliated with, endorsed by, or sponsored by any such third party.
You are paying Eat On Chain for an order-fulfillment service denominated in U.S. Dollars and settled by you in USDC. We are not selling food. The food itself is prepared and delivered by independent third parties subject to their own terms.
3. Eligibility
You must be at least 18 years old and located within a service area we currently support to use the Service. You represent that the wallet you connect is yours and that you have authority to spend funds from it.
4. Orders, pricing, and payment
When you build a cart, we display a quote in U.S. Dollars and a corresponding USDC amount that includes our service margin and expected fees. The USDC amount is valid only for the limited window shown on the payment screen. If your transfer does not confirm on Solana within that window, the order is automatically cancelled and no funds are claimed by us.
Once a transfer matching the order’s reference key is confirmed on-chain, we treat the order as paid and proceed to place it with the chosen third-party channel. Once placed, the order is generally non-cancellable except as described in our Refund Policy.
Quoted amounts are inclusive of our service margin (currently 5%). Restaurants set their own menu prices; we may add a small delivery, service, or convenience fee, all of which are itemized before payment.
5. Delivery and third-party services
Estimated delivery times are provided by the third-party channel and are estimates only. Eat On Chain does not directly prepare food, employ couriers, or guarantee any specific arrival time. Issues with food quality, packaging, courier conduct, or missing items are governed in the first instance by the third-party channel’s terms; however, if you contact us, we will work in good faith to assist with refunds or re-placement under our Refund Policy.
6. Wallets and on-chain transactions
You are solely responsible for the security of your wallet, private keys, and any seed phrase. Solana transactions are irreversible. We cannot recover funds sent to the wrong address, from a compromised wallet, or in an incorrect amount. Always verify the recipient address and amount in your wallet before signing.
We never request your seed phrase or private keys. Anyone who does is attempting to steal from you.
7. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose;
- Place orders you do not intend to receive;
- Use the Service to launder funds, evade sanctions, or facilitate any activity prohibited by U.S. law;
- Probe, scan, or attempt to bypass the Service’s authentication, payment, or fulfillment systems;
- Misrepresent yourself, your wallet, or your delivery address; or
- Resell access to the Service or build derivative services on top of it without our written permission.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY GIVEN ORDER WILL BE FULFILLED.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EAT ON CHAIN’S AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE U.S. DOLLAR VALUE OF THE ORDER GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
10. Indemnification
You agree to indemnify and hold harmless Eat On Chain and its affiliates from any claim arising out of (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any law or third-party right.
11. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and Eat On Chain waive any right to participate in a class action or class arbitration.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be flagged on this page with a new effective date. Your continued use of the Service after a change becomes effective constitutes acceptance of the revised Terms.
